ASPnet’s collaboration within the UNESCO networks. The 70th anniversary of the UNESCO Associated Schools Network

The article presents the Polish UNESCO Associated Schools Network (ASPnet). The Polish ASPnet was established in 1956. The activities undertaken in 2023 (for instance, the international Gift a Poem campaign) are presented together with the Polish celebrations of the 70th anniversary of this oldest UNESCO network. The analysis of the reports submitted by the Polish network members is provided with a special focus on networks, cooperation with other UNESCO family members, and UNESCO designations.

Streszczenie: W artykule zaprezentowana została Polska Sieć Szkół Stowarzyszonych UNESCO, która powstała w 1956 r. Przedstawiono działania podejmowane w 2023 r. (m.in. międzynarodową kampanię „Gift a Poem”) oraz polskie obchody 70-lecia tej najstarszej sieci UNESCO. Dokonano analizy raportów nadesłanych przez polskich członków sieci, ze szczególnym uwzględnieniem współpracy z innymi członkami „rodzin” UNESCO i desygnacji UNESCO.

The UNESCO Chairs and UNITWIN Networks are recognized as UNESCO’s “extended family” (Doc. 207 EX/11) and their membership brings a wealth of knowledge and expertise to UNESCO Programmes, while serving as an important dimension of UNESCO’s comparative advantage for other potential partners. The UNESCO Chairs Programme celebrates its 30th anniversary this year. The main celebrations for this achievement will be held in Paris in November 2022. The international conference is organized by UNESCO with the support of the French national commission for UNESCO. At the national level, more events will be held online and in person.

Artykuł przedstawia problem wywozu zabytków za granicę. Analizie została poddana procedura wywozu zabytku na stałe w kontekście kategorii wieku i wartości obiektu. Autorzy prezentują nowy test VOH (Value of Heritage), który może być stosowany przez rzeczoznawców Ministra Kultury i Dziedzictwa Narodowego. Pomoże to w dużym stopniu obniżyć ryzyko wydania decyzji nienależycie uzasadnionych czy niekorzystnych dla zachowania narodowego dziedzictwa kultury w Polsce.

Single Licence for Permanent Export from the Age and Value Requirements’ Perspective – between Cultural Heritage Protection and the Art Market in the Polish Legal System

Abstract

This article deals with the export of monuments and the existing combination of an object’s age and value while issuing permits. It provides an analysis of the procedure of permanent export focusing on a single license for permanent export in the Polish legal system. The authors offer a new questionnaire model (Value of Heritage Test) to support the procedure undertaken by experts of the Polish ministry of culture and national heritage involved in the process. The VOH test aims to diminish the risk of mistakes in assessing objects’ roles and meanings for national cultural heritage and reassure that the justification meets high standards. 

Wyjątkowość rynku sztuki obejmuje specyfikę przedmiotu obrotu i mechanizmów działania podmiotów biorących udział w obrocie, a także tradycję rynku opartą na szczególnej więzi między sprzedawcą a kupującym. Doświadczenia rynków zagranicznych z udziałem najsłynniejszych domów aukcyjnych potwierdziły, że rynek sztuki jest również narażony na wystąpienie porozumień ograniczających konkurencję i praktyki monopolistyczne. Obserwując rozwój polskiego rynku sztuki, przewiduje się, że wraz z umocnieniem się uczestników rynku dostarczających towar na rynek jako pośrednicy (domy aukcyjne) wkrótce mogą się na nim pojawić porozumienia ograniczające konkurencję. W artykule poddano analizie przepisy prawa unijnego oraz polskiego (w szczególności ustawę z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów). Jednocześnie ukazano wpływ zmieniającego się otoczenia prawnego zagranicznych rynków sztuki oraz polskiego rynku sztuki na zawieranie porozumień ograniczających konkurencję (niejednolite definiowanie przez ustawodawców krajowych kategorii narodowych dóbr kultury, dynamika zmian przepisów odnoszących się do wywozu zabytków oraz potencjał instytucji res extra commercium).

Acquisition of a title of ownership of a cultural object from an unlawful  vendor: selected issues

Abstract

Acquisition of ownership of movable property is of particular significance in the trade in cultural objects. Legal systems adopt different solutions which either allow or disallow acquisition in good faith of ownership of movable property. Another issue of importance is regulation governing the object of a transaction which is an item of cultural heritage. Under Polish law each item of movable property receives the same treatment with regard to the legality of a transaction. From the point of view of the trade in cultural objects, acting in good faith when purchasing such objects becomes of particular importance. The model of such acquisition is here shaped by legal principle, earlier judicial decisions as well as practices prevailing in the art market. Partial solutions of the issues discussed in the paper will be achieved after the adoption of an amended law on found property, in which objects entered into a national register of lost goods have been covered by a special legal regime.

Museum inventories and inventorying of collections in light of the UNESCO legal framework Summary: This article presents the problem of inventories in museums and inventories of collections in light of the UNESCO normative legal framework in cultural conventions and soft law (UNESCO recommendations). The authors aim to present issues related to the implementation of the UNESCO 1970 Convention, UNESCO’s recommendations for museums, and the importance of the inventory of cultural property in the fight against illicit trafficking of movable objects. Given new challenges, including recent armed conflicts, the inventorying of cultural property is particularly important in this context. It also constitutes an essential element in the protection system at the national and international levels. UNESCO’s planned projects to provide further support for inventories, such as a practical guide on inventories and illicit trafficking of cultural property, are highly relevant and welcomed.

Streszczenie: W artykule przedstawiono zagadnienia inwentarzy w muzeach i inwentaryzacji kolekcji w świetle dorobku normatywnego UNESCO jako podmiotu wyznaczającego standardy zawarte w dokumentach wiążących i o charakterze soft law (zalecenia). Zaprezentowano kwestie związane z implementacją Konwencji UNESCO z 1970 r. dotyczącej środków zmierzających do zakazu i zapobiegania nielegalnemu przywozowi, wywozowi i przenoszeniu własności dóbr kultury, z rekomendacjami UNESCO dotyczącymi muzeów oraz ze znaczeniem ewidencjonowania dóbr kultury w walce z nielegalnym obrotem ruchomymi składnikami dziedzictwa kultury. Wobec nowych wyzwań, w tym ostatnich konfliktów zbrojnych, ewidencjonowanie dóbr kultury jest szczególnie ważne w walce z nielegalnym obrotem dobrami kultury i w systemie ochrony na poziomie krajowym i międzynarodowym. Istotne są planowane przez UNESCO nowe projekty dotyczące dalszego wspierania inwentaryzacji oraz praktycznego przewodnika na temat inwentarzy i nielegalnego handlu dobrami kultury.
