https://doi.org/10.4467/25444654SPP.23.025.18497Section IIC of the Labour Code that was adopted by the Parliament in December 2022 introduces new regulations concerning remote work to Polish labour legislation. Thus, the binding legal provisions included in the anti-Covid legislation were repealed. The legislation authority established a new model of remote work. The aim of this study is to provide a general characteristic of this model. For the purposes of this article, I will focus mainly on the subjective and objective issues. The essence of remote work consists in performing this work at a location specified by the employee and agreed with the employer. The results of remote work are submitted with the use of means of remote communication. De lege lata, two types may be distinguished: contractual remote work and remote work that is designated unilaterally. This allows the parties to the employment relationship to adapt it in a flexible way to the diverse conditions of the work environment at the dawn of the post-industrial era.

https://doi.org/10.4467/25444654SPP.19.001.10144On 5 July 2018 the Polish Sejm adopted an amendment to the Trade Unions Act. It significantly changes the status of trade unionists at the company level. The starting point for further deliberations is that as from 1 January 2019 these entitlements will be granted not only to trade unionists employed on the basis of a contract of employment, but also to other persons engaged in gainful employment. By this I mean both those performing work on the basis of civil law contracts as well as self-employed. The July amendment to the Trade Unions Act regarding the legal status of trade unionists concerns their unpaid leaves, leaves from work duties and leaves to perform ad hoc activities and protection of sustainability of employment. These entitlements will be discussed in this Art. in such sequence.

In this light, the question arises, whether these changes significantly affect the status of workers who pursue their claims before labour courts. Right to fair trial is one of the basis of the Polish legal system. It also applies to labor disputes heard by labor courts. They settle not only disputes between parties to the employment relationship but also other cases arise from industrial relations. Moreover, jurisdication of the labor court does not include resolution of collective labor disputes. These disputes are settled in a separate mediation or arbitration procedure.

In the past, there was a statutory imposed limiting monism in the trade union movement of military services officers. Since 2019 trade union pluralism has been introduced for the Police, Border Guard, and Prison Service officers, which is analyzed in the paper. Another issue discussed in this article is the right of association of persons employed in civil public administration.

https://doi.org/10.4467/25444654SPP.19.025.10915The amendment to the Labour Code and the Code of Civil Procedure of 16 May 2019 clarifies the provisions governing the issuance of work certificates. It establishes new obligations for the employer and entitlements for the former employee. It strengthens the protection of his vital interests of a personal and social nature. It eliminates legal gaps previously existing in the system of Polish labour law. It significantly extends access to court proceedings in the event of failure to issue a work certificate.
