Reflecting on this topic, it should be emphasized that the most important thing for a debate on this issue is the best interests of the child, closely related to human rights. The article shows that the best interests of the child should take precedence over ideological issues. The study shows that due to the lack of transcription, the child is treated by public authorities as a “category B” citizen, and the practical aspect of having a Polish birth certificate is extremely important in everyday life. The main axis of the study is based on the arguments of opponents and supporters of the above-mentioned transcription, with a particular understanding of the constitutional and legal notion of family. The conducted analysis of the jurisprudence shows a different approach to the admissibility of transcribing the birth certificate of a child of a non-heteronormative couple. The article also shows the proper position of the Ombudsman in overseeing the observance of basic human rights.
